AMATERAS｜スマートアラーム 利用規約
この規約は、成田 海陸（以下「当方」）が提供するアプリ「AMATERAS｜スマートアラーム」（以下「本アプリ」）の利用条件を定めるものです。本アプリを利用した時点で、この規約に同意したものとみなします。
第1条（適用）
App Store から入手した場合は、Apple の標準使用許諾契約（Licensed Application End User License Agreement）とこの規約の両方が適用されます。両者の内容が食い違う場合は、法令で許される範囲でこの規約が優先します。ただし、Apple に関する定めについては Apple の標準使用許諾契約が優先します。
第2条（本アプリの内容）
本アプリは、スマートフォンのセンサーで測った体の動きから眠りの状態を推定し、設定した時刻の少し前から起こすアラームです。表示される眠りの深さなどは推定による目安であり、医療機器ではありません。病気の診断・治療・予防の目的には使用できません。
第3条（プレミアム）
- プレミアムは自動更新のサブスクリプションです。価格・無料期間の条件は購入画面とストアの表示に従います。
- 無料期間の対象は、ストアの規定により初めて購入する方に限られます。
- 更新日の24時間前までに解約しない限り、自動で更新され料金が請求されます。解約はストアのサブスクリプション設定から行えます。アプリを削除しても解約にはなりません。
- 支払・返金は各ストア（Apple、Google）の規定によります。期間の途中で解約しても日割りの返金はありません。
第4条（アラームについて）
本アプリは設定した時刻に鳴るよう予約しますが、端末の設定、省電力機能、OS の更新、端末の故障などにより鳴らない場合があります。はじめにテストで鳴ることを確かめてください。大切な予定がある日は、ほかの目覚ましとの併用をおすすめします。
第5条（禁止事項）
法令で認められる場合を除き、本アプリの解析・改変・再配布、その他法令に反する行為をしてはなりません。
第6条（責任の制限）
当方は、本アプリに関して利用者に生じた損害について、当方の故意又は重大な過失による場合を除き、損害が生じた日の前1か月に利用者が本アプリのために支払った金額（支払いがない場合は1,000円）を上限として賠償します。この上限は、当方に故意又は重大な過失がない場合（軽い過失による場合）にのみ適用します。
前項の上限は、法令上制限することができない責任（人の生命又は身体の侵害による責任を含みます）には適用しません。
第7条（規約の変更）
当方は、利用者の一般の利益に適合する場合、又は変更が合理的なものである場合に限り、この規約を変更できます。変更するときは、効力が生じる前に本ページ等で内容と効力発生日を周知します。
第8条（準拠法）
この規約は日本法に準拠します。ただし、利用者の居住国の法令で利用者に認められる保護を妨げるものではありません。

AMATERAS | Smart Alarm Terms of Use
These terms govern the use of the app "AMATERAS | Smart Alarm" (the "App") provided by Kairi Narita ("we"). By using the App you agree to these terms.
1. Scope
If you obtained the App from the App Store, both Apple's Licensed Application End User License Agreement and these terms apply. If they conflict, these terms prevail to the extent permitted by law, except that Apple's EULA prevails for matters concerning Apple.
2. The App
The App estimates your sleep state from body movement measured by your phone's sensors and wakes you slightly before your set time. Sleep depth and other figures are estimates. The App is not a medical device and must not be used to diagnose, treat, or prevent any disease.
3. Premium
- Premium is an auto-renewing subscription. Price and free-trial terms are as shown on the purchase screen and in the store.
- The free trial is limited to first-time subscribers as defined by the store.
- The subscription renews and is charged automatically unless cancelled at least 24 hours before renewal. Cancel in your store's subscription settings. Deleting the App does not cancel the subscription.
- Payments and refunds follow the rules of each store (Apple, Google). No refunds for partial periods.
4. Alarms
The App schedules the alarm to ring at your set time, but it may not ring because of device settings, battery savers, OS updates, or device failure. Please run a test alarm first, and use another alarm as well on important days.
5. Prohibited conduct
Except as permitted by applicable law, do not reverse engineer, modify, or redistribute the App, or use it in violation of law.
6. Limitation of liability
Except in cases of our intent or gross negligence, our liability for damages arising from the App is limited to the amount you paid for the App in the one month before the damage occurred (JPY 1,000 if you paid nothing). This limit applies only where we acted neither intentionally nor with gross negligence (i.e., in cases of ordinary negligence).
This limit does not apply to any liability that cannot be limited by law, including liability for death or personal injury.
7. Changes
We may change these terms only where the change suits users' general interest or is reasonable, and we will announce the content and effective date on this page before it takes effect.
8. Governing law
These terms are governed by the laws of Japan, without prejudice to protections granted to you by the mandatory laws of your country of residence.
